Terms and conditions of the online store

General Provisions.
1. These Regulations define the rules for use and operation of the online store operated by AKSIL Fabryka Specjalistycznych Wyrobów Lakierowych sp. z o.o. with its registered office in Pustków 365d, 39-205 Pustków, entered in the National Court Register by the District Court in Rzeszów, XII Economic Department of the National Court Register under the KRS number 0000319629, with a share capital of 50 thousand, NIP 872 23 36 742, REGON 180382298.
2. These Regulations are addressed both to Consumers and Entrepreneurs using the Store and define the rules for the use of the Online Store and the principles and procedure for concluding Sales Agreements with the Customer at a distance through the Store.
Definitions:
1. Consumer - a natural person concluding a contract with the Seller through the Store, the subject of which is not directly related to its economic or professional activity.
2. Seller - AKSIL Fabryka Specjalistycznych Wyrobów Lakierowych sp. z o.o. with its registered office in Pustków 365d, 39-205 Pustków, entered in the National Court Register by the District Court in Rzeszów, XII Economic Department of the National Court Register under the KRS number 0000319629, with a share capital of 50 thousand, NIP 872 23 36 742, REGON 180382298.
3. Customer - any entity making purchases through the Store.
4. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act grants legal capacity, performing a business on its own behalf, which uses the Store.
5. Store - online store operated by the Seller at the Internet address www.aksil.pl/sklep.
6. Distance contract - a contract concluded with a Customer within an organized system of contract conclusion at a distance (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
7. Rules and Regulations - these rules and regulations of the Store.
8. Order - the Customer's declaration of intent made via the Order Form and aimed directly at concluding a Contract for Sale of a Product or Products with the Seller.
9. Account - Customer's account in the Store, it collects data provided by the Customer and information about Orders placed by him/her in the Store.
10. Registration form - a form available in the Store that allows creating an Account.
11. Order form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
12. Shopping Cart - an element of the Store's software in which the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the details of the Order, in particular the quantity of products.
13. Product - a movable item/service available in the Store which is the subject of a Sales Agreement between the Customer and the Seller.
14. Sales Agreement - a contract of sale of a Product concluded or entered into between the Customer and the Seller through the Online Store. By Sales Agreement is also understood - applying to the characteristics of the Product - a contract for the provision of services and a contract for work.

Offer
1. products (paints, varnishes, impregnates, etc.) offered by aksil.pl are new and are manufactured by AKSIL. All prices presented in aksil.pl store are gross prices (including VAT).
2. The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including charges for transportation, delivery and postal services), of which the Customer is informed on the pages of the Store during the placement of the Order, including at the moment of expressing the will to be bound by the Sales Agreement.
3. We issue a fiscal invoice for each purchase or issue a VAT invoice at the request of the Buyer.
4. The Seller reserves the right to change prices and update product information.
Rules for placing orders
1. The basis for the execution of the order placed by the Buyer is the correct completion of the form located in the final stage of order placement. It is required to correctly fill in all fields of the form.
2. Orders are confirmed within 1 working day.
Forms of payment
1. The customer can use the following methods of payment:
  1. Payment on delivery with cash on delivery
  2. Electronic payment imoje supported by the company ING Bank Slaski
Rules of delivery of orders
1. Shipments are delivered by courier company POCZTEX to the address specified in the order form. Time of delivery of the order from the moment of dispatch 3-5 working days. In case of damage to the shipment in transit, delivery time may be extended.
2. The cost of shipping is paid by the Buyer.
3. Delivery of the Product takes place only on the territory of Poland.
4. In the case of delivery outside Polish borders, the Customer should contact the store before making the purchase in order to evaluate the cost of transportation.
5. complaints and returns (withdrawal from the contract)
6. In case of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint (within 2 years) based on the provisions on warranty in the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under warranty.
7. The Buyer may submit to the Seller, complaints about the concluded contract at the e-mail address: aksil@aksil.pl or in writing to the address of the Seller. A properly submitted complaint should include at least:
  
  name, surname, address, e-mail address, contact telephone number, date of conclusion of the Agreement forming the basis of the complaint, subject of the complaint, Buyer's request, any circumstances justifying the complaint.
8. If the data provided in the complaint requires supplementation, before considering the complaint, the Seller shall request the complainant to supplement it in the indicated scope.
9. The Seller shall consider the complaint within 14 days from the date of its receipt in its correct form.
10. The response to the complaint is sent to the e-mail address provided by the Buyer or to the postal address.
11. The Buyer has the right to choose the way of processing the complaint (the Buyer has the option, after the store accepts the defective goods, to receive a refund for the goods and delivery costs, to exchange the damaged product for another or has the option of new purchases for the equivalent of the advertised goods).
12. Buyer (consumer) of aksil.pl store has the right to return the purchased product without giving any reason. In this case, the Seller will return all payments received from the Buyer.
13. Within 14 calendar days the Buyer may withdraw from the contract. The 14-day period is counted in the case of a contract of sale from the date of receipt of the shipment by the Buyer. In order to withdraw from the concluded contract, an appropriate statement of intent must be submitted to the Seller.

15. Return of the item by the Buyer should take place no later than within 14 calendar days from the date of sending the declaration. Returned goods should be unused.
16. Within 14 calendar days, the seller will make a refund. The 14-day period shall be counted from the date of withdrawal from the contract (this is the day on which the seller receives the buyer's statement of withdrawal from the contract). The seller may withhold the refund until the item is received. In the event of withdrawal from the Contract, the Buyer shall bear the cost of returning the Goods.
Data protection
1. In accordance with Article 13 of the General Data Protection Regulation of April 27, 2016. (Official Journal of the EU L 119 of 04.05.2016) I inform you that:

2. Your personal data will be processed for the purpose of order fulfillment - on the basis of Article 6(1)(b) of the General Data Protection Regulation of April 27, 2016.

4. Your personal data will be stored for a period of 6 years
5. you have the right to request from the controller access to your personal data, the right to rectify, delete or restrict its processing and the right to data portability
6. you have the right to lodge a complaint with a supervisory authority
7. providing personal data is voluntary, however, refusal to provide data may result in refusal to process the order
Final provisions
1. The Regulations are effective as of December 25, 2014. (updated on August 10, 2020).
2. the Seller reserves the right to make changes to the Regulations, with the proviso that the new arrangements do not apply to contracts already in progress or completed.
3. In matters not covered by these regulations, the provisions of the Civil Code and other applicable laws shall apply.
